The company sent them an accounting , showing that they had forfeited the deposit and owed almost an additional $5000, which would have been the amount due for the remainder of the lease, as a reletting fee .  Under Texas law a landlord has a duty to mitigate damages if a person defaults on a lease.  The landlord did mitigate damages by releasing the property.  The two weeks damages caused by the vacancy was paid by my nephew.  Also under Texas law a landlord can only charge a reasonable fee relating to the actual cost of finding a new tenant.  The company referred the amount of the excessive reletting fee to a collection agency immediately.  The collection agency said that if the entire amount was not paid within a month it would be referred to credit reporting agencies-ruining their credit.  An attorney sent a demand letter for a proper accounting, but the company has still failed to respond, with only days remaining before the collection agency intended to send the unpaid debt to credit reporting agencies.  It appears that the only way to deal with this company is by actually hiring an attorney to file suit.

Don t use this company if there is any chance that your financial condition will change!  You will be forced to file suit to even get them to respond!
